These Terms & Conditions (“Terms”) govern your access to and use of creativepulse.us (the “Website”), which is owned and operated by Creative Pulse LLC (“Creative Pulse,” “we,” “us,” or “our”).
By accessing or using the Website, you acknowledge and agree to these Terms. If you do not agree with these Terms, you should not use the Website.
1. Website Purpose
Creative Pulse LLC provides video production, photography, web design, branding, marketing, social media, and related creative and professional services.
The Website provides information about Creative Pulse and its services and may allow visitors to contact us, request information or quotes, schedule appointments, subscribe to communications, communicate through chat or messaging features, or access other Website functionality.
Information presented on the Website is provided for general informational and promotional purposes and does not, by itself, create a client relationship or obligate Creative Pulse to provide services.
2. Client Agreements and Projects
These Terms govern use of the Website.
Specific projects and professional services provided by Creative Pulse may be governed by a separate proposal, estimate, statement of work, production agreement, service agreement, contract, order, or other written agreement (“Client Agreement”).
If a Client Agreement conflicts with these Website Terms regarding a specific project or service, the Client Agreement will control with respect to that project or service.
Submitting an inquiry, requesting a quote, scheduling a consultation, or otherwise communicating with Creative Pulse does not guarantee acceptance of a project or create a binding service agreement unless Creative Pulse and the applicable client enter into an agreement establishing such obligations.
3. Eligibility
The Website and Creative Pulse’s services are intended for adults and businesses.
By submitting an inquiry, scheduling an appointment, entering into a transaction through the Website, or otherwise using functionality requiring personal information, you represent that you are at least 18 years old and have the legal capacity to engage in the applicable activity.
4. Electronic Communications
When you communicate with Creative Pulse electronically, including through the Website, email, forms, chat, or other electronic means, you consent to receive electronic communications from us as reasonably necessary to respond to your communication or administer our relationship with you.
Electronic communications may satisfy legal requirements that communications be in writing to the extent permitted by applicable law.
Consent to receive marketing email or SMS communications is governed separately by the applicable consent mechanism and law.
5. SMS and Text Messaging Terms
Creative Pulse may operate SMS/text messaging programs for both non-marketing and marketing communications.
Depending on the consent you provide and your relationship with Creative Pulse, SMS messages may include:
- Inquiry responses
- Appointment confirmations and reminders
- Scheduling communications
- Project or service updates
- Customer-service communications
- Follow-up communications
- Promotions and special offers
- Service announcements
- Past-client or customer reactivation messages
- Other communications consistent with the consent provided
Marketing and non-marketing SMS consent may be requested separately.
Consent to receive marketing text messages is not a condition of purchasing services from Creative Pulse.
Message Frequency and Charges
Message frequency may vary depending on your interactions with Creative Pulse and the types of communications you have agreed to receive.
Message and data rates may apply according to your wireless carrier and service plan.
Opting Out
You may opt out of applicable SMS communications at any time by replying STOP.
After you submit an applicable opt-out request, you may receive a confirmation message indicating that your opt-out has been processed. You will no longer receive messages covered by that opt-out unless you subsequently provide valid consent to receive them again.
Support
For assistance regarding SMS communications, reply HELP, call or text +1 (617) 459-8187, or contact contact@creativepulse.us.
Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
Delivery of SMS messages is subject to effective transmission by your wireless carrier and network provider and is outside Creative Pulse’s complete control.
Privacy
Our collection and use of information in connection with SMS communications are governed by our Privacy Policy, available on the Website.
6. Email Marketing Communications
Where permitted by applicable law, Creative Pulse may send commercial or promotional email communications.
Marketing emails will provide an appropriate method for opting out of future marketing communications.
You may unsubscribe using the mechanism provided in the applicable email or by contacting us.
Opting out of marketing emails does not prevent Creative Pulse from sending transactional, relationship, contractual, administrative, or service-related communications when otherwise permitted.
7. Appointments and Scheduling
The Website may allow users to request or schedule consultations, meetings, calls, or other appointments.
Submitting or scheduling an appointment does not guarantee that Creative Pulse will accept a project or enter into a Client Agreement.
You agree to provide accurate scheduling and contact information and to make reasonable efforts to cancel or reschedule appointments you cannot attend.
Additional appointment, cancellation, deposit, or service terms may be disclosed during scheduling or established in a separate Client Agreement.
8. Quotes, Estimates, and Proposals
Any pricing, service descriptions, packages, examples, or other information displayed on the Website are informational unless expressly identified as a binding offer.
Quotes, estimates, proposals, and scopes of work may be subject to additional terms, expiration dates, assumptions, exclusions, deposits, or Client Agreements.
Creative Pulse reserves the right to accept or decline prospective work in its discretion, subject to applicable law and existing contractual obligations.
9. Payments
The Website may offer payment, invoice, deposit, or checkout functionality through third-party payment processors.
Additional payment terms may apply to a particular transaction or Client Agreement.
You agree to provide accurate payment and billing information and authorize the applicable payment processor to process amounts you approve or owe under the applicable transaction or agreement.
Creative Pulse does not guarantee the availability of any particular payment method or payment processor.

12. User Submissions
If you submit messages, information, files, feedback, testimonials, or other materials through the Website, you represent that you have the right to provide those materials and that doing so does not violate applicable law or the rights of another person.
Except where a separate agreement provides otherwise, submitting information through the Website grants Creative Pulse the limited rights reasonably necessary to receive, store, process, and use that information for the purpose for which it was submitted.
Submitting confidential project information through a general Website form does not by itself create a confidentiality or nondisclosure obligation.
